However, this decision is not insignificant, because it will directly influence your future life as a freelancer.
So what status for an independent consultant?
Personally, as a freelance IT consultant, I took the time to benchmark the advantages and disadvantages of each status. To have an even more precise idea, I contacted freelancers to exchange their feedback. With hindsight, I would say that this choice must above all meet your expectations.
The microenterprise is very attractive because it is easy to create and to access. In recent years, the micro regime has been simplified to the maximum in order to reduce management formalities and offer the autoentrepreneur the possibility to concentrate on his core business.
Every month or quarter, you declare your turnover. Your social charges are proportional to your turnover. The latter is limited to 70 000 €/year for services and 170 000 € for the sale of goods.
As an entrepreneur, you are personally liable: this means that professional creditors can seize your personal assets in case of unpaid debts.
The EIRL differs from the micro-business in two respects: the turnover is not limited and the assets are legally separated. If you choose an EIRL, you must declare an appropriation. All you have to do is to list the assets that you decide to attach to the company and to dissociate them from your personal assets. Secondly, you will be asked to open a dedicated business account.
With this status, you will be recognized as a legal entity. The creation and management procedures can be tedious and costly. As a sole shareholder, you are affiliated to the regime of non-salaried worker also called TNS. This is a less beneficial regime than that of salaried employee or assimilated.
A self-employed person who starts up alone can also opt for the creation of a SASU. The single-member simplified joint stock company differs from the EURL in its flexibility. The law in force gives you a lot of leeway to organize your SASU as you wish. It has only one member. As president of a SASU, you are attached to the general social security system. With the EURL, it is the only legal form that allows you to create a company without having a partner.
The portage agreement sets the rules for hosting your activity within the company. It stipulates the terms of collaboration, the relational organization and the mutual commitments of each party. This agreement concludes your registration as an employee. It notifies your agreement to entrust the company with your administrative, legal and social management.
As a consultant in the IT field, I consider freelance administration as a unique and hybrid solution.
In addition to the status of employee, your invoicing is followed by a chartered accountant, as well as the administrative management which is entirely delegated to the portage company. In other words, you are autonomous in your activity while having social benefits identical to those of an employee.
By opting for freelance administration, you are free to work on the missions of your choice, to fix your fees, and to manage your agenda as you wish. By becoming a freelance employee, you automatically benefit from a professional liability insurance. Not to mention the unemployment benefit, the right to paid vacations and social protection through the company's collective mutual insurance.
